Council grants encroachment easement for Cooper’s load-out area
Summary

The Village of Fort Recovery council on Oct. 7 passed RES 2024-25, authorizing an encroachment easement for Cooper’s load-out area after motions to suspend the rules and adopt the resolution carried.
Randy Diller, a village staff member, explained that Cooper’s load-out has historically occupied public right-of-way and that formalizing an easement “is a good time to get it right.” Diller said that placing the activity under an easement makes insurance coverage more likely for that specific use and that “they have been using it this way for at least 50 years.”
Council members voted to approve the resolution after brief discussion; council minutes record the motions and an affirmative vote. Diller noted the easement language restricts use to the activity described and that any change in use would not be permitted under the encroachment agreement.
The resolution was passed as an emergency measure at the meeting; the council did not record any dissenting votes in the minutes.
