Franklin City Council unanimously adopts guardrail funding, retroactivity waiver and HB 197 meeting suspension

The Franklin City Council on April 20, 2020, meeting virtually, unanimously adopted three resolutions related to transportation safety, labor-contract administration and the authority to conduct virtual public meetings during the COVID-19 emergency.
City Engineer Barry Conway described Resolution 2020-21 as the preliminary legislation required by the Ohio Department of Transportation (ODOT) District 8 for a district-wide replacement of Type A anchor assembly guardrails on NHS local routes that include portions of SR 73 and SR 123 in Franklin. Conway said the work will replace five Type A anchor assemblies at three locations — two on North Main Street at Kenneth Koons Boulevard, two on East Second Street west of Stadia Drive and one on East Second Street east of Conover Drive — and is scheduled in the fourth quarter of the State's 2021 fiscal year. The district-wide project is currently estimated at $702,482 and Conway said it is 100% funded with Safety Funds. Councilmember Paul Ruppert moved to adopt Resolution 2020-21; Mathew Wilcher seconded. The motion passed unanimously.
City Manager Sonny Lewis presented Resolution 2020-22, a retroactivity waiver for all units of the Franklin Law Enforcement Association. Lewis said collective-bargaining negotiations have been suspended due to the declared emergency and that the existing contract expires at the end of July 2020; he explained that, if negotiations are not completed by that date, negotiated pay will be paid retroactively. Vice Mayor Todd Hall moved to adopt Resolution 2020-22; Michael Aldridge seconded. The motion passed unanimously.
Lynnette Dinkler, the Law Director and acting clerk of council, introduced Resolution 2020-23 to suspend city charter, codified ordinance and council-rule provisions inconsistent with amended Substitute House Bill 197 retroactively and through Dec. 1, 2020 (if the emergency continues), in order to allow virtual public meetings. Debbie Fouts moved to adopt; Paul Ruppert seconded. Council voted to adopt with no recorded opposition.
The council conducted roll call votes for each measure and recorded unanimous approval. Mayor Brent Centers authorized his digital signature for passed legislation and approved the minutes. The meeting adjourned at 6:31 p.m.
