The Village of Gambier Planning & Zoning Committee reported to council on Jan. 5 that it denied a Bed & Breakfast application because the property owners do not meet the residency requirement — they live in California — and therefore do not qualify under the Village’s residential district rules.
Council members discussed whether the zoning code needs clearer language addressing limited liability companies and whether the village should use a beneficial ownership approach to determine residency for conversion or short‑term rental requests. Solicitor Clinton Bailey advised that reviewers would look through the corporate entity to identify the natural person who would need to qualify as a resident and that he would review the zoning code to provide clarifying language and return the item to Planning & Zoning.
Council directed the solicitor and planning staff to draft possible code clarifications and to take proposed language to the Planning & Zoning Committee for consideration at a future meeting.
