Davison County Drainage Board recommends Kibbie Ditch cleanout after neighbor dispute

Mitchell, S.D. — The Davison County Drainage Board voted Feb. 17 to recommend that the Board of County Commissioners approve a cleanout of Kibbie Ditch between 407th and 408th Avenues, following a dispute between neighboring landowners over drainage tied to a 2023 permit.
Guest landowner Jeff Terveen told the board he did not receive a notification letter about Chris Nebelsick’s 2023 drainage application and believed his signature was required. "The project is directing water toward my land," Terveen said, adding that the extra water is affecting his production and access to a field. He asked that a new underground outlet line be installed and requested that some of his trees be preserved during any ditch work.
Nebelsick, who owns property affected by the drainage work, told the board he followed applicable Davison County and Natural Resources Conservation Service procedures and noted there were historical drainage issues in the area before his project. He said he had attempted to resolve the matter with Terveen previously but the neighbors did not reach an agreement, and he warned that installing a new underground line would be ineffective without first restoring the ditch’s capacity.
Highway Superintendent Rusty Weinberg told the board county crews could perform a cleanout, but Acting Administrator Wegleitner said the ditch and surrounding land lie within the 100‑year floodplain and floodway and that she would consult the State to determine whether engineering studies or other regulatory reviews are required before work proceeds.
The board voted on a motion by Buchholz, seconded by Chet Edinger, to recommend to the Board of County Commissioners that Kibbie Ditch be cleaned out on the property legally described as the South Half of the Northwest Quarter and the South Half of the Northeast Quarter of Section 32, Township 103 North, Range 60 West of the 5th Principal Meridian (property owned by Jeff Terveen). The roll call was: Buchholz — aye; Bult — aye; Edinger — aye; Larson — aye; Blaalid — aye; Nebelsick — abstain; Klumb — aye; motion carried.
Votes at a glance: the board also elected Jay Larson chairperson (motion carried by roll call) and Chet Edinger vice‑chair; it approved the meeting agenda and the Nov. 18, 2025 minutes by roll call votes. The board set its next meeting for March 17, 2026, at 7:00 p.m.
The board’s recommendation will go to the Davison County Board of County Commissioners for final approval; Acting Administrator Wegleitner said staff will consult state officials about floodplain and regulatory requirements before any county work begins.
