Davison County board approves drainage permit after redesign addresses neighbor's concern

The Davison County Drainage Board voted unanimously March 17 to grant a drainage permit to landowner Spencer Neugebauer to install subsurface drainage on the NW 1/4 of Section 4, T101N R60 in Davison County.
The board approved a plan that calls for approximately 200 feet of 12-inch solid pipe and 36,715 feet of perforated 4-, 6-, 8- and 10-inch tile on Neugebauer's property, with outlets routing water into an intermittent stream that feeds Twelve Mile Creek and ultimately the James River. Acting Administrator Wegleitner said the application was received Feb. 18, neighboring landowners and the public were notified March 3, and the notice was published March 7.
Gridline Field Tile representative Derek Evans told the board he submitted a revised drainage plan after a neighboring landowner, George Ryks, raised concerns that the original design directed all the runoff northwest onto his wet ground. "The revised plan incorporates an additional outlet to the southeast, splitting the drainage between two directions and substantially reducing the volume of water flowing toward Ryks," Evans said, and he reported that Ryks reviewed the updated design and indicated his concerns had been addressed. Evans also said downstream landowners Nebelsick and Miller signed the required consent forms authorizing drainage across their property and that the plan includes a one-time cleanout of an existing ditch on those properties to ensure conveyance to Twelve Mile Creek.
Board members asked whether both outlets discharge into a mapped blue-line channel; Evans confirmed they do. After reviewing the items required by the Davison County Drainage Ordinance and SDCL 46A-10A, the board took a roll-call vote: Buchholz, Bult, Edinger, Larson, Blaalid, Nebelsick and Klumb all voted aye and the motion carried. The board recorded no special conditions for the permit.
The formally recorded motion to grant the permit was made by Bult and seconded by Edinger. The meeting record lists no amendments to the motion and states the permit was approved "based on findings." The board set no follow-up deadline in the public discussion.
