Gorby said the proposal "changes the consistency of the residence," arguing that permitting a second dwelling on the parcel could set a precedent for similar splits elsewhere in the neighborhood. John Entingh, the applicant, presented his stance toward how the R‑1 ordinance applies to the property, asserting that the application should be considered under the ordinance language submitted with the variance application.
In response to questions about legal interpretation, Solicitor Meade read the ordinance’s stated purpose aloud for the board: "The R‑1 District is established to provide for the continuance of single family housing within the older portions of the Village of Sugar Grove." Meade also referenced the ordinance’s exception provisions (noted in the application as 6.01.02) while disputing an assertion that allowing one multifamily dwelling would necessarily lead to widespread change.
After hearing the exchange and the solicitor’s reading of the R‑1 purpose, the commission chose to postpone further action to allow additional review. The motion to table was made by Mayor Tyson Nye, seconded by Council Member G. Selby, and passed unanimously, 5‑0. The commission scheduled further consideration of the variance at its regular meeting on Dec. 10, 2024, at 6 p.m. at Village Hall.
