Jenkinsburg council approves special exception for automobile service on N. Hwy. 42 over one dissent

The Jenkinsburg City Council voted July 28 to recommend a special exception permitting an automobile service establishment on N. Hwy. 42 in the city’s H-B (Highway-Business) zoning district.

Council Member Brent Eberspacher moved to recommend approval; Council Member Gary Brown seconded. The motion passed with three ayes and one nay — Council Member Gary Roberts recorded the lone vote against the motion.

The approval was tied to multiple conditions set by the council and staff, including the requirement of an annual city business license; submission of any required state license at annual renewal; prohibition on maintaining a continuous open lot for vehicle sales on the subject property; application for a land-disturbance permit and a building permit prior to excavation or construction; compliance with the design criteria of the Hwy. 42 Overlay District; a condition making the special-exception approval non-transferrable (requiring a new application on sale or transfer); and signage that complies with the Jenkinsburg zoning ordinance and Hwy. 42 Overlay standards.

Mayor Pro-Tem Jason Watts opened the hearing and the council heard comments both in support and opposition before closing public comment. The minutes record the vote and the conditions; no additional procedural actions or appeals are recorded in the meeting minutes.

The council’s decision carries conditions intended to ensure site permitting and design standards are met before operation.
