The Statham City Council entered an executive session on Feb. 4, 2025 to consult with legal counsel regarding pending or potential litigation under Georgia Code §50-14-2(1). Councilmember Penn moved to enter the executive session at 8:14 p.m.; the motion passed 5-0.
The minutes record that the council re-entered open session at 8:30 p.m. with a recorded 5-0 vote to exit executive session and that no votes were taken while the meeting was closed to the public. In open session, the council adopted a resolution ratifying the closed-session discussions as within the statutory exceptions and directed the mayor to execute and file a notarized affidavit with the official minutes pursuant to O.C.G.A. §50-14-4(b).
Mayor Debi Krause executed the affidavit stating under oath that the closed portion of the meeting was devoted to matters within the exceptions provided by law (attorney-client privilege and related exceptions) and the affidavit was prepared to be filed with the meeting minutes. The resolution and affidavit are recorded in the minutes and signed as part of the official record.
