Planning commission approves findings for Petition 2601 after correcting municipal code reference

The Mobile Planning Commission approved written findings of fact for Petition 2601 (Philponen) at a special meeting, after amending the draft to correct a scrivener's error in the municipal code citation.

Heather, a staff member, told the commission the findings would normally be presented at the next commission meeting but that appeals to the Board of Works were already pending. "These are the findings if you wanna add, delete, any corrections, can expedite moving this forward," she said, urging the commission to provide a clear record for the Board of Works.

A staff member identified that paragraph 3 of the draft findings referenced "section 150.14" in error and recommended the citation be corrected to "section 150.104." A committee member moved to approve the findings and amended the motion to include the corrected code reference; the motion was seconded and put to a roll-call vote.

The roll call recorded ayes from several members, including Schultz, Perry, Gallagher, Hanna and Metz, and at least one no vote; the chair declared the motion carried. A staff member briefing the commission had emphasized that the Board of Works needs both the February minutes and the written findings to render an opinion on the appeals.

The commission accepted the special meeting agenda at the start of the session and then moved into the findings review. The special meeting concluded with the approval of the findings and the commission's adjournment.

Next steps: the approved findings and the commission minutes will be provided to the Board of Works for consideration in the pending appeals process.
