The Village of Garland Planning Commission reviewed a permit application for a US Cellular tower on Jan. 23, questioned how the proposal complies with Seward County codes and deferred a final decision pending further review.
Andy Bobrytzke, a consultant for US Cellular (SMJ int.), attended to answer questions about the tower’s design and permit details. Landowner Richard Bohaty told the commission he had no hesitations about the tower and provided contact information for his law firm, Baylor, Ernen, Wolfe & Tannehill, for follow-up communications.
Commissioners raised questions about whether the tower conforms to Seward County ordinances, requested to see tower blueprints and asked about insurance clauses. Commissioner Nate Longacre moved to approve the permit; Diane Regnier seconded. The minutes record a tally of two ayes and three nays. The minutes also note the motion "did not follow the proper discussion procedure of Roberts Rules of Order." The commission agreed to research relevant tower ordinances and zoning requirements before bringing the matter to the Board.
The commission did not record a finalized approval; members directed staff and commissioners to obtain ordinance guidance, contact a local person identified as Kirkland about his hesitations, and review permit and construction documentation before the next meeting.
