The Franklin City Council on April 17 unanimously adopted Resolution 2017‑25 to object to the June 1 renewal of Permit No. 6279063 (Classes D2, D2X, D3, D3A) held by NYNY Inc., dba New York New York, 1121 E. Second Street.
Law Director Donnette Fisher told council the State conducts routine renewals on June 1 and that objections must be filed by May 1. She said the State completed an investigation of the business and that there is a separate, ongoing criminal investigation involving the licensee and/or its managers. Based on those inquiries, Fisher said the city recommends objecting to renewal and will attach written opinions from Police Chief Russ Whitman and herself when the objection is filed.
The resolution lists multiple grounds for objection as written in the minutes, including that the applicant or managers are under investigation for crimes affecting fitness to hold a liquor permit; that they have operated in a way demonstrating disregard for state and local laws; that managers are alleged to have used alcohol or dangerous drugs to excess; that the location is so situated it could interfere substantially with public decency, sobriety or good order; and that the premises may be declared a nuisance under Chapter 3767 of the Ohio Revised Code.
Councilmember Todd Hall moved the resolution; Carl Bray seconded. The motion passed unanimously.
Why it matters: an objection from the local legislative body is part of the State's administrative review process and may affect whether the Division of Liquor Control renews the permit. The minutes record the city’s objection and the reasons it cites; the record does not contain a response from NYNY Inc. or its representatives.
