Bennet City Council approves water-rate ordinance, adopts Board of Adjustment bylaws and OKs multiple infrastructure and finance moves

The Bennet City Council met Nov. 10, 2025, at Bennet City Hall and approved a series of ordinances, resolutions and project contracts affecting water rates, stormwater work and city finance.
Mayor Ryan Cheney opened the meeting and the council first removed two consent items for separate discussion: the Lower Platte South NRD Hazard Mitigation Plan and a Catlett Surveying fee related to the Quincy Street right-of-way project. Councilor Dan Zieg moved and Pete Simmons seconded the motion to pull those items; roll-call vote recorded YES: Josh Buck, Jesse Schmidt, Pete Simmons and Dan Zieg.
On formal business the council adopted RESOLUTION 2025-11.5 to remove existing members of the Board of Adjustment after municipal code changes that allow the council to serve as the board. Dan Zieg moved and Jesse Schmidt seconded; roll-call vote was YES: Zieg, Schmidt, Simmons, Buck. The council then approved adoption of the Board of Adjustment By-Laws by the same margin.
On ordinance business the council approved the final reading of Ordinance 2025-8.1, amending water-usage rates. Pete Simmons moved and Dan Zieg seconded; roll-call vote recorded YES: Simmons, Schmidt, Zieg and Buck. With that vote the ordinance passed on final reading.
Council approved multiple public-works items after presentations from City Engineer Brian Schuele. The Pavers proposal for an area inlet at Van Buren and Garden was approved (motion by Dan Zieg; second by Josh Buck; roll-call YES: Schmidt, Buck, Simmons, Zieg). The council also approved cleaning the ditch on the north side of Cottonwood at Cochrane Corner to improve drainage, with the work capped at $13,000 and requiring mayoral approval (motion by Pete Simmons; second by Jesse Schmidt; roll-call YES: Zieg, Simmons, Schmidt, Buck).
In personnel and appointments, the council approved RESOLUTION 2025-11.2 appointing Brian Friedrichsen as the 2026 Street Superintendent (item listed on the consent agenda). The minutes also record a resignation from Justin Stark as Street Superintendent; that resignation was noted as part of the consent items.
On finance the council authorized transfers of reserve funds. Jesse Schmidt proposed moving funds from Union Bank & Trust into other investment vehicles. By motion of Dan Zieg and second from Pete Simmons the council moved "1.1ML" from UBT to NPAIT (roll-call YES: Schmidt, Simmons, Zieg, Buck). The council also approved transferring $248,387.50 into SLGS bonds per the schedule provided by Schmidt (motion carried; roll-call YES: Buck, Zieg, Simmons, Schmidt).
The council addressed a variety of routine matters: it approved a park lighting installation request contingent on the Bennet Community Fund raising the required funds and authorized a Park Fund donation up to $1,000 with mayoral approval; it reviewed proposed changes to the USPS lease and instructed staff to obtain an inspection quote related to environmental-clause concerns; it tabled the Lower Platte South NRD Hazard Mitigation Plan to December for further consideration; and it postponed the maintenance building bid process until December.
The council entered a closed session at 9:35 PM to discuss pending litigation and returned to open session at 9:47 PM. The meeting adjourned at 9:49 PM.
What’s next: Several items pulled from the consent agenda—including the hazard mitigation plan and the Quincy Street right-of-way surveying item—were left for follow-up and expected back on the December agenda; a finalized Uribe contract (with attorney revisions) is also scheduled for December consideration.
