An attorney for the owner urged that the fines be released if the owner stayed in compliance for a probationary term. "If he remains in compliance for maybe a 60 or 90-day period that the fines be completely released," the owner’s attorney said, urging a probationary approach.
Board members discussed multiple proposals for probation length and immediate payment. One member said the owner appeared "98%" compliant and argued for a longer probation to ensure sustained compliance. After negotiation, a motion was made to accept a $1,000 payment, suspend the larger fine while holding a portion in reserve, and require one year of compliance before any further forgiveness.
The motion was seconded and carried by voice vote with one recorded dissent. The board also directed staff and the owner’s counsel to draft a formal compliance agreement reflecting the payment, the probationary period and the conditions for forgiving the suspended portion of the fine.
The settlement ends the immediate enforcement hearing; staff said they will confirm the details in a written agreement and follow up on compliance during the probationary year.
