The resolution specifies that, once finalized by the town’s legal counsel and executed by the developer and the town, the BOT agreement will govern design, construction, temporary operation and eventual transfer of the project. The council also authorized the president of the council or another authorized individual to negotiate, finalize and execute the necessary documents and certificates in consultation with legal counsel.
A motion to approve Resolution 2026-01 was moved and seconded; the council adopted the resolution by voice vote, the chair said. The resolution includes standard severability language, a conflict clause that repeals inconsistent ordinances and a provision that the resolution will remain in effect until all payments due are satisfied; the resolution may be amended only with the developer’s consent if the developer has provided financing.

The resolution conditions the award on final agreement of terms between the town and developer.
