A Commonwealth Engineering representative told the council Division A work is progressing and that progress payment application #9 was before the council; retainage for that application was listed in the packet at $49,104.13 with a balance figure shown as $932,978.37 payable to the Patterson contractor. Council approved the pay application by voice vote.
On Division B, the engineer said the Insight contractor had completed most pipeline and manhole rehabilitation work but had outstanding items in the town park area. The contract listed an original substantial-completion date of July 5 and a contractor-requested date of Aug. 28; the engineer described the contract’s liquidated-damages provision ($2,500 per day) and stated a worksheet in the packet produced a potential aggregate LD figure of $132,500 if the council chose to assess damages. The council did not impose LDs at the meeting; the engineer said staff and the contractor would discuss damages during an upcoming progress meeting.
The council approved Change Order #3 for Division B, a deductive change order that removes two items (interior lining and related work for an interior manhole inside the treatment plant, and cleaning/CCTV/CIP work for a railroad crossing between specified manholes). The engineering packet listed the credit amount as $45,287; the engineer explained the railroad work was removed because the railroad’s permitting contact had been unresponsive for weeks and the town did not want that work to remain a contract hostage. Council approved the change order by voice vote.
Council also approved Division B pay application #6; the packet shows a payment-to-contractor figure of $566,301.11 after retainage, which staff said represented roughly a 73% project completion on a dollar basis though the contractor reported higher physical percent complete.
Commonwealth Engineering said a progress meeting would occur this week to review punch-list items, the park-related work and the potential assessment of liquidated damages. The council directed staff to continue communications with the contractor and the railroad representative and to report back at the next meeting.
