The Etna Green Town Council adopted Ordinance 2026-01, which defines "shipping container" and permits commercial entities within town limits to place a reasonable number of shipping containers on business premises while prohibiting their use as residential structures.
Nick, the drafter, presented the short ordinance and told the council no public hearing was required for this action. "It defines commercial entities and then the important stuff is in section two, which says that commercial entities within the town are permitted to have a reasonable number of shipping containers on their premises," Nick said.
Council members discussed potential loopholes and edge cases. One member asked whether a resident who established an LLC could then place containers in a yard; members agreed the ordinance should specify it applies to brick‑and‑mortar commercial premises rather than simply an LLC registration. "If he's got a brick and mortar commercial business, then he's got an argument that he's a business entity," one member said; others responded that a lone van‑based operator should not be allowed to install a container at a residential lot.
The council moved to adopt the ordinance and proceeded with signatures. Members asked that the signed version be scanned and retained for the record.
