The Washington County Board of Commissioners voted unanimously on June 15 to authorize the prosecuting attorney to draft and execute a temporary easement with property owner Tanya Moye so the county can proceed with construction of Gentry Lane.
Prosecuting Attorney True Pearce told the Board that all parcels except the Moyes’ had been cleared and recorded; the remaining hold-up involved a VA loan and Wells Fargo. Pearce said a temporary easement signed by Moye would allow the county to move the fence and construct the road while the title issue is resolved, and that the easement could specify the county’s intent to pursue eminent domain only as a last resort. Pearce asked whether the Board wanted him to draft the easement, and Commissioner Nate Marvin moved to authorize the prosecutor to do so. Gordon Wilkerson seconded; roll-call votes were “Aye” from Wilkerson, Harberd and Marvin and the motion carried.
Pearce said the county would not pay for the property while only holding a temporary easement but could compensate for damages once the road is completed if title were later acquired. The Board instructed Pearce to prepare the easement for signatures and noted recorded documents for the other parcels were in place.
