Middletown council approves public-safety LOITs, several ordinances and schedules water-rate hearing

The Middletown Town Council convened Nov. 17, 2015, in the Public Meeting Room at 653 Locust Street. Town Council President Betty Riley led the pledge, and Clerk-Treasurer Drew Cooper recorded the presence of council members Betty Riley, Shelly Kimmerling, Dave Wagner, Gary Kendall and Norm Purdue and Town Attorney Joel Harvey.
The council voted on several motions and readings of ordinances and one resolution. Norm Purdue moved to direct the Utilities Superintendent to change all key locks on the Civic Center; Dave Wagner seconded and the motion passed unanimously.
Clerk-Treasurer Drew Cooper read Contractor’s Progress Estimate Number 13 and, on a motion by Dave Wagner seconded by Norm Purdue, the council authorized payment to 3D Company, Inc. in the amounts listed in the estimate — $25,660.50 from the State Revolving Fund (SRF) and $2,552.52 from local funds — provided SRF approval is obtained and correct change-order documentation is on file. The council president also directed Town Attorney Joel Harvey to investigate 3D Company, Inc.'s claim that the payment method used on the 5th Street Stormsewer Project resulted in underpayment of $13,614.16.
The council adopted Resolution 2015-11-17-1, an interlocal cooperative agreement between the Township of Fallcreek and the Town of Middletown, on a unanimous vote after Drew Cooper read the resolution into the record.
By suspension of the rules for second readings, the council approved multiple ordinances. Drew Cooper read aloud ORDINANCE NO. 2015-5 "AN ORDINANCE ESTABLISHING A POLICE PUBLIC SAFETY LOIT FUND AND A FIRE PUBLIC SAFETY LOIT FUND," which the council approved unanimously after a motion by Betty Riley and a second by Norm Purdue.
The council similarly approved Ordinance 2015-6, amending a 2008 ordinance to increase electric rates charged to customers of Middletown, by unanimous vote. For traffic control, the council approved Ordinance 2015-7, establishing stop signs on Locust Street (an amendment to the town traffic schedule). That vote was split: Dave Wagner, Shelly Kimmerling and Gary Kendall voted yes; Betty Riley and Norm Purdue voted no, and the measure passed 3-2.
Ordinance 2015-8, prohibiting parking in certain areas of Middletown, passed its second reading unanimously after Drew Cooper read the ordinance. The Clerk-Treasurer then introduced Ordinance 2015-9, amending a 2013 ordinance to increase rates charged to customers of the Middletown Water Utility; the minutes record the ordinance reading but do not specify the new rate amounts.
To allow the State Revolving Fund to complete bond closing for the Water Treatment Plant Replacement Project before year end, Dave Wagner moved and Gary Kendall seconded a motion to schedule a special town council meeting and public hearing on Tuesday, Dec. 8 at 7:00 p.m. The motion passed unanimously.
