Middletown delays release of contractor retainage as stormsewer punch list remains

Books told the council the town could assess liquidation damages against contractor 3D Company before releasing retainage if the punch-list items are not completed. Council President Betty Riley asked the engineers to draft a letter to 3D informing the company that the town will wait for completion of the punch list before releasing retainage and that liquidation damages will be deducted, and the town attorney said he would review the letter before it is mailed.
No formal vote was recorded in the minutes; the record shows the council gave direction to staff and consultants rather than taking a formal motion on the retainage release. The minutes note that only two property releases remain as the condition to finish the contractor’s final punch list and finalize the project closeout.
The action leaves the contractor’s retainage withheld pending completion of contract requirements and any deductions the town may assess for delays or damages. The meeting adjourned after other announcements.
