Statham council holds closed session on real estate and files affidavit

At 7:24 p.m. on Jan. 6 the Statham City Council voted to enter executive session to "discuss or vote to authorize negotiations to purchase, dispose of or lease property" under Georgia Code §50‑14‑3(b)(1)(B). Councilmember Penn moved to go into executive session and Councilmember Burnette seconded; the motion passed 5–0.
The council exited executive session at 7:32 p.m. City Attorney Jody Campbell told the council that discussions held during the closed portion of the meeting are protected by attorney‑client privilege and that no votes were conducted during or after the executive session. An affidavit signed by the mayor was prepared for filing with the official minutes stating the closed portion of the meeting was devoted to matters within the exceptions to open‑meeting law and identifying the specific exception for real estate negotiations. The council adopted a resolution ratifying the closed‑session actions and directing the mayor to execute the affidavit for the official record.
The affidavit and resolution, included in the meeting record, cite O.C.G.A. §50‑14‑4(b) as the statutory basis for filing the sworn statement with the minutes.
