County attorney: Clark County remains out of compliance with hearings board order; July 31 compliance date stands

Rebecca Ward Palmerton, senior civil deputy prosecuting attorney, updated the Planning Commission on ongoing hearings-board litigation related to the county's comprehensive plan update. She said a board order on April 2 found the county in noncompliance and set a July 31 compliance deadline with status-check dates on May 4 and June 1; the board denied a motion for reconsideration of the noncompliance finding.

"We are out of compliance," Ward Palmerton told commissioners, adding that county staff and outside counsel have filed documentation to update the board on progress and that the county may file motions for incremental extensions if appropriate and warranted by documented good-faith efforts.

Ward Palmerton also summarized a separate motion by the organization identified in the record as Friends of Clark County seeking an order finding the current plan invalid; she said the board recently issued an order rejecting the invalidity claim on grounds that actions are not finalized and that meeting criteria for designation does not mandate immediate designation.

Why it matters: the hearings-board finding constrains the county's schedule, complicates grant eligibility and may limit certain actions until the county demonstrates compliance or secures an extension. Staff told the commission they are documenting all compliance efforts and will pursue extensions only as needed.
