Pine Island council votes to retain local authority for cannabis retailer registrations

Councilors voted to retain Pine Island’s authority to register cannabis retailers after a staff and legal briefing on the practical consequences of delegating that power to a county. Staff said retaining local registration preserves the city’s ability to set zoning conditions and a local cap on retailers.

“When a city does that you forfeit ... the ability to set your own cap on the number of retailers within your city,” the city attorney explained, warning that delegating registration to a county could subject the city to the county’s total retailer cap and create confusion in a city that sits in two counties.

Council members raised concerns that a county cap concentrated in one neighboring city could effectively block retailers in Pine Island if the city deferred registration authority. After discussion, a motion to retain the registration designation passed; council members noted the decision could be revisited later if circumstances change.

Staff said the administrative work of municipal registration is similar to tobacco registration and manageable for city staff, though it would require clerical processing and occasional inspections coordinated with county law enforcement if delegated.

The council did not set a numeric cap at the meeting; staff suggested future work could explore whether an explicit city cap is desirable and feasible.
