Council holds first reading to rezone former JCPenney for Boys & Girls Club project

The common council on June 23 heard the first reading of Ordinance No. 1545, a request to rezone property at 503 East Ives Street (Parcel 33-03216) from community mixed use (CMU) to planned development (PD) to enable the Boys & Girls Club to acquire and renovate a roughly 30,000-square-foot former department store attached to the Marshfield Mall.
Acting planning staff (filling in for City Planner James Levin) told the council that because the building currently shares structural walls, common systems and parking with the rest of the mall, the property cannot meet CMU district requirements once it is separated and must be processed as a planned development. The rezoning is being requested in conjunction with a property line adjustment and will allow the club to own and operate the facility independently while requiring a subsequent specific implementation plan within 12 months if the general development plan is approved.
Staff and the plan commission recommended approval subject to conditions, which the presenter listed as: demonstration of building and fire separation for the divided structure; demonstration of adequate shared parking; execution of cross-easements and maintenance agreements; owner consent and control documentation (record easements/contracts); approval of a certified survey map to create the required new parcel; and confirmation that the change will not negatively affect a 2022 development agreement covering valuation and other provisions.
Council members asked about the risk of rezoning before final agreements are in hand and whether rezoning would create uses permitted in PD that could apply if the Boys & Girls Club project failed to proceed. Staff replied that preliminary review showed no conflicts with the development agreement but that final covenants and the implementation plan must be reviewed and resolved prior to final approval. City staff said the specific implementation plan and certified survey map would be returned to council for review and that second reading and possible adoption are tentatively scheduled for the July 14 council meeting.
Next steps: Council will revisit Ordinance No. 1545 on July 14 when the second reading and adoption could occur if outstanding implementation details are resolved.
