At the June 23 meeting, the Foxborough Select Board updated the public on litigation filed by Kraft Sports and Entertainment related to the New England Patriots’ stadium license for fiscal year 2026–27. Kraft has sued the town after disagreeing with the town’s position that certain stadium-related costs beyond event-day expenses should be borne by the team or stadium operator.
Town officials told the board that Kraft submitted alternative proposals that would shift many long-run costs to the town — including police details and insurance — and that the town cannot accept terms without a clear understanding of the long-term financial effects. The town noted the original lease contains lengthy extension options and that substantive changes to the lease process would likely need to go back to town meeting for approval, per the town’s legal counsel.
Officials said the legal process and any negotiations could take months, and the board may need to hire a consultant with stadium fiscal expertise to quantify the town’s exposure over multiple decades before agreeing to any new arrangement. The board also emphasized it is not negotiating in public at the moment and that residents should not expect a rapid resolution absent a proposal that is financially feasible for the town.
Board members asked staff to continue updates as information becomes available; no formal action was taken on the suit during the meeting.
