Leawood planners require Evergy easement vacation before permitting for Parkway Plaza Everbrook Academy daycare

The Leawood Planning Commission approved the revised final development plan for Parkway Plaza Everbrook Academy daycare, adding a stipulation that requires the developer to demonstrate the vacation of a private Evergy power easement that is shown running under the proposed building before a permit is issued.

Commissioner Fishman asked whether the easement had been vacated and whether vacation should be a condition of approval. "There is a power and light easement on the plan plat that runs directly under the building," Fishman said, asking staff whether the vacation was complete. City Engineer Brian Scoville replied that the easement is private to Evergy and that it would be up to the developer to work with the utility for vacation; he recommended adding a stipulation requiring vacation prior to permitting.

Commissioner Fishman offered the stipulation and Commissioner Block moved to approve case PC093-2026 with the nine existing stipulations plus Commissioner Fishman's stipulation (for a total of 10 stipulations). The motion was seconded and the commission approved the final development plan unanimously.

Staff noted the vacation and coordination with Evergy are the developer's responsibility and that the added stipulation typically requires the easement to be vacated prior to construction permitting to ensure conflicts are resolved before building. The approval allows the project to proceed through the remaining governing body and permitting processes, subject to the required coordination and demonstration of easement vacation.
