Staff member Bart presented a review of the Clark County Historic Preservation Commission’s Rules and Procedures and recommended removing two outdated sections he identified as redundant with county functions.
Bart told the commission the "special valuation section is completely covered in the county code" and that the current-use program is administered by the assessor, not the commission. He said those two sections "can go completely" but cautioned that other parts of the county code reference the Rules and Procedures, so wholesale deletion could require follow-up code coordination.
Commissioners discussed alternatives. Several members favored adopting by reference—linking to the National Register paperwork or the Secretary of the Interior’s standards—rather than embedding the standards in the local rules, arguing links keep the local document current if federal guidelines change. Staff agreed to consult with the Department of Planning (DAP) and Michelle Thompson to see how other jurisdictions handle similar language and to ensure linked materials meet accessibility requirements.
Bart said staff will return with a clean draft after cross-checking code references and coordinating with city counterparts so the commission does not inadvertently create a gap where code expects the Rules and Procedures to provide binding text.
Next steps: staff will schedule a coordination call with city staff and DAP, verify which code sections reference the Rules and Procedures, and provide a revised draft one or two meetings from now.
