Planning staff told the board that, before issuing a written decision, Ada County Code 1-14-6 allows reopening the record for good cause and that newly discovered evidence—specifically historic documentation showing Old Pearl Road remains a dedicated public roadway—had not been offered by the applicant during the original review. "Old Parole Road our surveyor was able to find documentation that Old Parole Road is still a public roadway," planning staff said. The staff recommendation limited reopening to drainage, site grading and trail/pathway matters so notice and comment could be narrowly focused.
Commissioners discussed the scope of the reopening and the notice process. One commissioner summarized the practical purpose: giving both sides time to research issues and respond rather than attempting to add substantial, contentious conditions through a time-extension procedure. Planning staff said the county would re-publish legal notice, re-notify neighbors and partner agencies, and repost the site with the new hearing date.
The board then moved to reopen the record and table further action to the Aug. 12 public hearing; the motion specified the reopening would be "limited to drainage, site grading, trail pathway considerations, including any modifications or additions to the conditions of approval necessary to address those topics," and to include the Old Pearl Road public-road determination. The chair said the Board would review new evidence gathered at that hearing before issuing a final planning decision.
What happens next: staff will re-notice the narrowly scoped hearing and accept additional testimony and evidence on the listed issues; the Board will review the newly submitted material after the hearing before making a planning decision.
