Board members discussed whether the stored tires were part of a business operation and whether the violations should be treated as separate counts. The city attorney advised that the board could enter one order addressing both violations or break them into two motions under the same case.
After deliberation, the board split the enforcement outcome: it found the property in violation of both the parking ordinance and the IPMC rubbish section, set a compliance deadline of Oct. 23, 2025, and imposed a $150-per-day fine for the parking violation and a $50-per-day fine for the accumulation of rubbish for failure to comply. The motion passed on roll call.
Officer Defoe and the board encouraged the property owner to communicate with code enforcement to address outstanding issues and to correct the property within the time provided.
