The House Committee on Economic Competitiveness adopted substitute H-2 language for House Bills 51, 52 and 53 and reported the bills to the full House with recommendations.
The chair summarized the substitute language before the votes: the H-2 for House Bills 51 and 52 holds a purchaser of property liable to a homeowner for damages allegedly caused by the purchaser; the H-2 for House Bills 51 and 53 requires the purchaser to record the sale or transfer document and a notice of rights with the county register of deeds within 30 days after the sale or transfer is completed. Representative Altman moved to adopt the substitute for HB 51 and 52; Majority Vice Chair Bonak moved to adopt the substitute for HB 51 and 53. Representative DeBoer moved to report HB 51 and 52 with the H-2 recommendation, and Representative Harris moved to report HB 51 and 53 with the H-2 recommendation.
The clerk completed roll calls for the motions and announced that each motion prevailed and the substitutes were adopted or the bills were reported with the H-2 recommendation. The transcript's clerk announcements contain formatting inconsistencies for the reported tallies; the clerk's recorded announcements (as transcribed) were parsed as approximately 9 yeas for the first adoption, 10 yeas for the second adoption, and a third report announced as 8 yeas with 2 passes. Because the roll-call lines are inconsistently transcribed, exact vote tallies by name are not asserted here; the committee record should be consulted for certified vote counts.
The chair also read into the record submitted testimony cards. In support of the bills, Jeff Kilpatrick of the Michigan Court Officers and Deputy Sheriffs Association and Jordan Clint, listed as chairman of the Harbrier County Mission, filed cards. In opposition (not wishing to speak), Joanne Masaraca of MMLA Mortgage Lenders and Jeff Weiserman of Trout Law filed cards opposing the bills. The cards were entered but those individuals did not take the floor during the meeting.
The committee approved previous minutes by unanimous consent, the minority vice chair moved to excuse absent members and the committee adjourned with no further business.
Next steps: the bills were reported to the full House with committee recommendations; further consideration, floor scheduling and final votes will be determined by House leadership.
