Michael Robertson, speaking during the public comment portion of the commissioners court meeting, said he filed a public-records request last August for search warrants related to a residence connected to an alleged school shooter. Robertson said the 38th Judicial District Attorney Christina Mitchell objected; the matter went to the Texas Attorney General, and Robertson said the AG issued a letter decision dated Oct. 22 ordering release of the records.
"She was notified after that. She said she was going to appeal. She had an appeal window. She failed to meet that appeal window," Robertson told the court, adding that failure to appeal made the AG's letter decision binding under Texas law. "To this day, she has not released it. I have also submitted a complaint to the attorney general's office."
Robertson entered a copy of the attorney general's letter decision into the public record at the meeting and urged the court to encourage the district attorney to comply with state law. The transcript records no response or statement from District Attorney Christina Mitchell in the meeting record.
Note on names: the transcript referenced the Texas attorney general; public records indicate the state attorney general is Ken Paxton. Robertson referred to the office decision and said he had filed a complaint with the attorney general's office; no county action was recorded at the meeting to compel release.
Next steps: Robertson asked the court to press the district attorney to comply; the court acknowledged his comments but took no formal action on the request during this meeting.
