Planning commission split on Gemmill variance for outdoor storage

Attorney Christian Miller and applicant David Gemmill appeared before the commission to discuss a Zoning Hearing Application seeking a Special Exception to expand a business and a variance under Section 418 to allow outdoor storage. Chairman John Shanbarger moved to recommend approval of the Special Exception if the requirements of Section 418 are met, or to recommend approval if a variance that includes installation of a fence is granted. Bruce Miller seconded the motion.
When the commission recorded its vote on the variance, three members voted not to approve the variance and two members voted to approve the variance with the condition of a fence. The transcript records the numerical split but does not attach member names to individual votes. Because a majority did not vote to approve the variance, the planning commission did not record approval of the variance in the meeting minutes.
The matter was scheduled for the zoning hearings set for Oct. 29, 2025. The planning commission's recommendation is advisory to the Zoning Hearing Board, which will make the final determination.
