Council approves standardized stormwater agreement for Cedar Woods

Jeff Netzinger, director of engineering and projects, told the council Cedar Woods approached the town after Hurricane Debbie with persistent drainage problems in its low-lying, older neighborhood and that staff determined the subdivision qualified for the town’s standardized drainage agreement. "They were made aware of that and then made a formal recommendation," Netzinger said, adding this would be the town’s 27th agreement of this type.

The presentation described the agreement as consistent with prior terms and covering runoff that drains through public rights-of-way to the marsh outfall; Netzinger said driveway pipes and some roadside ditches remained the HOA’s responsibility. Council members asked whether any upgrades to the marsh outfall were needed; staff said no major outfall upgrades were required based on current information.

After brief questions, a council member moved to consider the resolution and the chair called for a voice vote. The council approved the resolution; members raised hands in assent and the chair noted the item was approved. The motion authorized execution of a standardized stormwater agreement for the Cedar Woods subdivision.

The agreement’s immediate effect is to make the town responsible for the portions of the drainage system that convey water in public rights-of-way; staff said that some driveway-level pipes and certain roadside deficiencies remain the property owners’ maintenance responsibility. The council did not attach additional conditions at the time of approval.
