Planning and Zoning Commission approves preliminary and final site plans for proposed 185-foot wireless tower, conditioned on recorded easements

The Planning and Zoning Commission on Dec. 16, 2024 approved preliminary and final site plans for application P-349, a proposed wireless communications facility consisting of a 180t monopole communications tower with an overall height of 185 feet at 222–245 Maintenance Road. The approval was unanimous, 4-0, and was conditioned on recording required utility and access easements before the final plan is recorded.

Town staff reported the revised land development plan had addressed technical comments but noted one outstanding issue: easements for utilities and access had not yet been recorded. "The only comment that is remaining ... is that the easements that need to be obtained for both utilities and access are yet to have been recorded," said Mr L, who provided the staff report and recommended approval contingent on those easements being completed prior to recordation of the final plan.

John Tracy of Young Conway, speaking for the applicant, said the team had previously presented to the Board of Adjustment and that the current filing responds to the town's technical requirements. "We've satisfied the town's requirements ... once you have any questions we're good to go," Tracy said, while noting some easements have been obtained but may need to be shifted and "I don't believe we've obtained any easements yet" with regard to certain parcels and approvals.

The application describes an 8,431-square-foot landsite and lists Bear Trap Properties LLC as the property owner. Staff said the plan will be reviewed under Article 18, Section 140-3116 (requirements for wireless communications facilities). The motion to approve P-349 — including both the preliminary and final plans and the conditions identified in the staff assessment dated Dec. 16, 2024 — was moved and seconded; the chair called roll and the motion passed 4-0 (yes: Mr Nicholson; Mr Donado; one commissioner recorded in the transcript as "mavar"; the chair voted yes).

Commissioners posed no additional technical questions during the meeting. The approval requires that the outstanding easements be recorded and that all conditions in the staff letter be satisfied before the final plan is recorded; the applicant must return with proof of recorded easements as required by staff. The meeting adjourned following the vote.

Next steps: the applicant is expected to record the required easements and satisfy the remaining conditions listed in the town staff letter before the final plan is recorded; no further public hearing was scheduled during this session.
