Residents challenge Hubert Lane short-term rental renewal; council allows IUP to run to May while planning commission reviews ordinances

Amy Grinsteiner, a Hubert Lane resident, told the Rockville City Council that the short-term rental interim use permit at the center of recent controversy had legally expired and that council retains authority to add conditions to any renewal. "Section 28 subdivision 5 says termination — an interim use permit is terminated on the day it expires," she said, urging that original stipulations be written into any renewed permit.
Jeff Ingolome and Joy Do, two neighboring residents who live on Hubert Lane, offered sharply different factual claims about the property. Ingolome said the council’s original intent was to limit the frequency of rentals, not to require single seven-day bookings: "A 7-day rental never meant that someone must rent for 7 days. What we were concerned about was the frequency of rental." Do said her survey showed the lot measures about 14,900 square feet and argued the parcel conforms to lot-size requirements; she defended the property owner’s right to use the land within legal bounds.
Council members discussed whether the original IUP included a finite expiration or only a six-month review and wrestled with how the city's existing moratorium on short-term rentals affects renewals. Staff and councilors agreed the moratorium prevents new applications while it remains in effect, but, as Bobby noted, the issued IUP predates the moratorium. After discussion about committee work and ordinance updates, the council voted to allow the Hubert Lane IUP to remain in place through its one-year anniversary (May 14) and directed planning staff and the planning commission to aim to return proposed ordinance revisions to the council by May.
The decision preserves the status quo for the property through the spring while the city clarifies rules governing future short-term rental permits. No formal enforcement action or revocation was taken at the meeting; councilors repeatedly said there were no recorded violations of the IUP. The matter will return to council after the planning commission’s review and any recommended ordinance changes.
