Associate Planner Eduardo Lomeli presented the staff report and said the site is in the mixed‑use overlay and C‑2 zone, described the 4,500‑square‑foot single‑story building with two tenant spaces (one vacant), and noted that the police department reported no recorded complaints or calls for service at the address. Staff recommended adopting the resolution approving the CUP with the attached conditions and making a CEQA exemption determination.
Applicant representative Bruce Evans told the commission the request is modest, that distilled spirits would be limited to about a "4‑foot wide shelf" and that the preference is to keep spirits behind the counter; if necessary they would be displayed in a locked cabinet at the front of the store. Evans asked that the resolution include a parenthetical noting a prior mailing address (562 West Arrow Highway) to prevent confusion with the ABC application.
Commissioner Richardson moved to adopt the resolution as recommended by staff with the applicant's requested address clarification; Commissioner Flores seconded. Roll call recorded unanimous approval: Commissioners McMeekin, Richardson and Flores and the chair all voted Aye. The motion passed 4‑0. The decision is final subject to a 10‑day appeal period under CMC 17.62.0.13.
