Swisher council approves two voluntary annexations along 120th Street in split votes

The Swisher City Council on Nov. 25 approved two voluntary annexations along 120th Street, voting 3‑2 on each measure. On motions by Council Member Kody Pudil, seconded by Adam Roeder, the council approved Resolution 32‑2024 for Brad and Sandie Degen’s 12.58‑acre parcel (Parcel ID #0305452005) and Resolution 33‑2024 for David D. Sheely’s 41.90‑acre parcel (Parcel ID #0305452003).
The votes for both annexations were Pudil, Roeder and Mayor Pro‑Tem Michael Stagg in favor; Daryl Hynek and Curt Cline opposed. Council records show the pair of annexations together add 54.48 acres to city limits.
Council members tied the annexations to ongoing work on the Division/120th Street improvement project: earlier in the meeting the council approved a contingent reimbursement of $121,056.54 to Johnson County Secondary Roads for construction costs related to the properties being annexed. That payment was approved earlier in the meeting on a vote of Roeder, Stagg, Cline and Pudil in favor and Hynek opposed, and the clerk said the payment would be placed on a future agenda as a formal resolution to comply with a code requirement.
During discussion, Council Member Daryl Hynek cited Swisher City Code 17.03, paragraph 3, noting that “A resolution must be passed to spend public funds in excess of one hundred thousand dollars ($100,000.00) on a public improvement project.” Clerk Shelley Annis acknowledged she was unaware of the requirement and said the $121,056.54 payment will appear on the next agenda as a resolution.
Next steps listed by the council include formalizing the reimbursement item as a resolution before payment and updating meeting records to reflect the newly annexed parcels.
