State inspection rates Curve Street dam 'poor'; commission to build options decision tree

An Office of Dam Safety inspection found the Curve Street dam in poor condition and the commission heard that the finding requires a certificate of noncompliance and a dam-safety order under state regulation 302 CMR 10.08.

Megan read the inspector’s summary to the commission: "as a result of the poor condition rating, please be advised that... DCR is required to issue the town of Carlisle a certificate of non-compliance and dam safety order," and she listed the report’s principal concerns: heavy vegetation and trees growing on the structure, and erosion where the cover separates from concrete. Commissioners discussed the possible next steps — repair, replacement (culvert/bridge) or removal — and raised questions about jurisdictional complexity, water rights and long-term costs.

Commissioners asked staff to develop a clear decision tree that lays out options, costs, regulatory steps (including whether the structure would still be regulated if decommissioned), downstream impacts, and community values to guide a multi-meeting deliberation. No formal motion to repair or remove was made; the item was left as an informational matter and a staff assignment to gather needed information and to share that with commissioners.

Why it matters: a 'poor' rating from dam safety carries regulatory consequences and potentially large fiscal and hydrologic implications for the town and for cranberry-bog infrastructure upstream and downstream.
