Dayton council accepts Baker Farms phase three contingent on seeding and grading; $5,000 escrow approved

The Dayton Town Council voted Jan. 21 to accept facilities for public maintenance at Baker Farms phase three and to approve a $5,000 escrow intended to guarantee completion of required seeding and grading by April 1, 2025.
Town Board President Marc Buhrmester described remaining work at the subdivision and said developer Greg Milakis offered an escrow agreement to ensure completion. Ryan Munden, attorney for Milakis Homes, told the council that "the check could be deposited and paid back upon completion of the seeding and grating." The council accepted Resolution 2025-2, which authorizes the town to accept the facilities for public maintenance, and also approved accepting the $5,000 escrow.
Munden also reported that property across the street had been annexed and that 109 homes were proposed for that parcel; council members raised concerns about existing water-pressure issues and discussed options to address pressure before moving forward on additional development approvals.
The council’s acceptance of the resolution and escrow was recorded by roll-call votes with all members present voting to approve those items. The council also directed staff to follow applicable procedures for final acceptance once the developer satisfactorily completes the required work.
