Scott, a county staff member, summarized the history: a 1981 resolution previously assigned planning and zoning responsibility for Burden to Brown County, but recent state guidance and local circumstances indicate Burden does not currently meet state incorporation criteria and has limited local governance capacity. "It's my understanding when I checked into it with the state ... they have to petition to the state to dissolve their incorporated status," Scott said, noting the county does not plan to force dissolution but will remove Burden from the county publication listing until the community resolves its status.
Why it matters: the change clarifies which areas the county regulates under zoning rules and avoids listing a community that lacks a functioning municipal structure. Commissioners noted the county will re-open jurisdictional questions if Burden later straightens out its incorporation paperwork.
Commissioner Denn moved to exclude Burden from the ordinance listing; Whis seconded the motion. The motion carried by voice vote.
Staff said the practical effect is that zoning regulations will apply to the unincorporated area as part of the township rather than as an interior municipal jurisdiction until Burden obtains or clarifies its municipal status. Commissioners observed that if Burden pursues a commercial development such as a Dollar General the county would revisit jurisdiction and permitting arrangements.
The commission set a hearing date to finalize the ordinance language as amended.
