Council updates FEMA flood claim; declines land sale request and keeps statutory tort limits
Summary
Clerk and public works staff reported FEMA coordination on the June 2024 flood claim and that Gilbertson Lane rip rap was completed. The council declined a land-sale/lease request from Demeter Land Development and voted not to waive statutory tort liability limits per insurance counsel.
Clerk Mary Miner and Public Works Supervisor Trenten Chiglo updated the council on the town's FEMA flood claim from June 22–July 4, 2024. Miner said she and Chiglo met with FEMA representative Ivy Jackson on Oct. 7 and later by phone and that she provided labor and equipment summaries along with the Minnesota Department of Natural Resources permit for the Gilbertson Lane work. Chiglo reported the rip rap on Gilbertson Lane has been placed and that remaining invoices and labor/equipment hours will be submitted to FEMA when final tallies are complete.
The council also considered a letter from Demeter Land Development asking whether Rushford Village would sell or lease the land under the town solar array; the council voted not to pursue a sale or lease (motion by Robert Hart, second by Rick Ruberg). Miner noted Rebecca Charles (CEDA/DEED) had submitted a monthly report and that CRV received a $12,000 Taylor Rural Improvement Grant to replace the hall merry-go-round; Charles also applied for a Safe Routes to School grant that same day.
On insurance, CRV's agent Butch Johnson recommended the city not waive statutory tort liability limits in the LMC liability-waiver form; City Attorney Joseph O'Koren explained that waiving those limits would require purchasing additional coverage to address incidents such as trip-and-fall claims. The council voted to maintain the statutory tort liability limits (motion by Mike Ebner, second by Travis Link).
