Planning Commission approves Brackett’s Point preliminary plat and easement vacation

The Orono Planning Commission on Aug. 19 approved a preliminary plat (LA 24-39) to rearrange boundary lines among three properties at Brackett’s Point, vacate a portion of perimeter drainage and utility easements, and allow a former tennis court to be combined with 1480 Brackett’s Point.
Miss Curtis, speaking for staff, described the application as a boundary-line adjustment rather than a subdivision and recommended approval. “Staff is recommending approval of the preliminary plat, including the proposed easement vacation as applied,” Curtis said. She noted no new lots are proposed and that notice had been sent to utility companies; no formal comments were received from utilities.
Applicant George Stickney told the commission the change cleans up obsolete lot lines, removes a tennis court that has not been used for 17 years, and preserves the stormwater pond and high-ground areas. When commissioners questioned whether the yellow-marked easement was a drainage easement and whether utilities were affected, staff and the applicant said utilities serving homes are in the road and that existing drainage flows to the storm pond would not change. In response to a commissioner’s question about erosion risk, the applicant and staff said there is no anticipated change to drainage or increased erosion.
A commissioner flagged a typographical reference in the staff report to a “conservation design report” that does not exist for this file; staff confirmed the line is a typo and will be removed from the record.
Commissioner Libby moved to approve LA 24-39 as applied; the motion was seconded, put to a voice vote and carried. The approval formalizes the boundary-line adjustment and the easement vacation as described in the application; staff indicated replacement easements were not required because remaining easements will continue to encumber the outlot.
