Council voids second dog-at-large fine, retains initial complaint

At its Oct. 14 meeting the Melbourne City Council reviewed a nuisance hearing involving a dog-at-large complaint for 107 3rd Avenue and voted to void a second complaint and the related $130 fine while retaining an earlier complaint from February.
Angie Gunderson and Blake Nyberg, the property residents who requested review, attended with neighbors who had filed complaints. After discussion about competing accounts of the incident and confirmation from the mayor that proper procedures were followed in issuing the fine, Councilor Beth Opperman moved to void the second complaint and fine; Councilor Gaege Bracy seconded and the motion passed unanimously.
Mayor Cynthia Rae Mansager noted that facts differed among parties but that the issuance followed required procedures. The council reiterated that only signed complaints will be acted upon for nuisance follow-up going forward. During the same discussion Paul McGrew raised concerns about stray cats in the neighborhood; Clerk Mary L. Pothast advised residents to stop by city hall and complete a complaint form to trigger an initial nuisance letter.
No further enforcement action was recorded at the meeting; the city said future complaints will be processed under established nuisance policy.
