Swisher mayor says hybrid meetings are now required; council warned municipal liability for sidewalks will grow

Swisher’s mayor told the council July 8 that state law now requires municipalities to offer a hybrid or virtual option for all council and board meetings and that the city will continue providing those options. The mayor said the change comes from Senate File 2385 and that “it is no longer optional — it will always be hybrid or virtual.”
The mayor also briefed the council on an Iowa Supreme Court ruling that makes municipal sidewalks the liability of the municipality for trip-and-fall claims. The mayor said staff will conduct a townwide survey of sidewalks and present options to council, noting that the city can still require homeowners and businesses to perform maintenance: “We can still require homeowners and business owners to do the maintenance,” the mayor said.
City staff said they will inspect sidewalk conditions and bring proposed ordinance edits and budget implications back to a future meeting, so council members can weigh whether to require private property owners to make repairs or to use city resources to fix dangerous sections first. The mayor said staff’s early review will be completed before an anticipated August or September follow-up to guide whether the city must change code language or budgeting practices.
The matter affects routine maintenance responsibilities and potential liability exposure for the city; council members asked staff to prioritize mapping and an options memo for a forthcoming meeting.
