Vandalia council approves fence variance for HT Hackney at 875 Center Point Drive

The Vandalia City Council unanimously approved variance BZA 26-005 on a motion to allow a decorative black wrought-iron front-yard fence at 875 Center Point Drive for applicant HT Hackney.
Council voted to approve the variance with three conditions: the fence along Center Drive will be black wrought iron and shall not exceed 8 feet in height; it must not be installed beyond the east side of the structure (the side facing Brownsville Road); and the transition to chain-link fencing on the west and north sides will occur at the southwest corner after the westernmost driveway. The motion, made by Vice Mayor Fallick and seconded by Councilwoman Eva Lottes Weaver, passed on a roll call vote of 7-0.
Staff presented background from the Board of Zoning Appeals, which on June 10, 2026 recommended approval of a front-yard fence along Center Drive but recommended denial of a front-yard fence along South Brown School Road and denial of proposed barbed wire in the front yard. The applicant subsequently withdrew the requests related to South Brown School Road and barbed wire and agreed to decorative fencing along Center Drive.
An applicant representative described the company's business model and why additional perimeter security is needed. The representative said state policy in Ohio enabling "qualified distribution centers" can exempt some interstate shipments from the commercial activity tax and that the facility handles high-value products that require protection. "It's one person's capital that we're wanting to protect," the representative said.
Council also clarified technical conditions during discussion: the fence location should remain behind the front of the building and not extend beyond the east side, and the chain-link transition should occur after the westernmost driveway to facilitate gate placement.
The council voted in favor: Councilmember Dugan, Councilmember Ford, Councilmember Hathaway, Councilmember Bradford, Councilmember Avalotis Weaver, Vice Mayor Fallick and Mayor Herbst all voted yes. The motion carried 7-0.
The council then recessed from this agenda item. The applicant was told to proceed consistent with the conditions set by council.
