Buhl Council grants access easement for Jones Avenue properties and agrees to investigate boundary conveyance

The Buhl City Council unanimously granted a permanent access easement across City-owned land to allow ingress and egress to the rear yards and detached garage at 99 Jones Avenue and 101 Jones Avenue, and agreed to continue investigating a conveyance or sale of city-owned land to resolve a property-boundary encroachment affecting 99 Culver Avenue.
On the easement request, All American Title and the affected property owner Gabriel LaBarge had reported that the only practical access to the rear yard and garage at 99 Jones Avenue crosses City-owned property. The City Attorney advised that granting an easement is preferable to a Letter of Understanding. Councilor Towner moved to grant an access easement for ingress and egress to the owners of properties at 99 and 101 Jones Avenue; Councilor Kealy supported the motion, which carried unanimously. The Administrator said he will work with the City Engineer and City Attorney to finalize the easement language and legal descriptions.
On property boundaries, Gabriel LaBarge asked the council to consider modifying a conveyance to Mike Anderson so that a northwest corner of LaBarge’s yard and a portion of an existing sauna would not encroach on land Mr. Anderson seeks to acquire. The council directed staff to continue investigating a conveyance or sale that would match the current yard boundaries and to produce legal descriptions; interested parties were told they would bear surveying and engineering costs. Councilor Towner moved to continue investigation into a potential conveyance or sale to Gabriel LaBarge; Councilor Loeffler supported the motion and it passed unanimously.
The council also noted an existing Mesabi Trail segment that crosses the affected parcels and said any permanent easement or conveyance would need to address trail rights. No sale or conveyance was finalized at the meeting; staff were directed to return with legal descriptions and options for council consideration.
