Commission approves executive-session settlements, lease and legal-services extension

Augusta commissioners returned from an extended executive session and immediately approved several formal actions resulting from that closed meeting.

Attorney Plunkett asked the commission to authorize the mayor and clerk to execute a commercial-waste application lease as permit holder with Alamo Farms & Cattle LLC for property in Jefferson County; a commissioner moved the request and it was seconded and recorded as approved by the clerk.

The commission then approved two financial settlements announced in open session. Counsel requested approval to settle all claims by Al Mims against Augusta and Christopher Lavaris for $47,000; the motion was moved and seconded and the clerk recorded the vote as unanimous. Later the body approved satisfying the judgment in Eddie Kemp v. Augusta by paying $98,000, again moved, seconded and recorded as carried by the clerk.

Counsel also sought and won approval to extend the interim legal-services transition plan covering Jim Plunkett and John Manton through Dec. 31, 2026 under the same terms as prior extensions. Commissioners moved and seconded that extension; the clerk recorded the motion as carried.

Clerk statements during the meeting indicated the motions were recorded as carried or unanimous; the meeting transcript did not present an individual roll-call vote for each action. The motions were introduced in open session immediately after the group reconvened following the closed meeting.

The agenda items recorded in the public minutes listed the lease authorization, the two settlement payments, and the legal-services extension as the primary formal outcomes of the executive session.
