The applicant requested two waivers: a fee in lieu of constructing a sidewalk (the area has no existing sidewalks) and exemption from the street‑light requirement. Planning staff confirmed that the town engineer had no exceptions and the health department’s preliminary review showed site suitability for septic. Commissioners voted to waive the street‑light requirement and to accept the fee in lieu of sidewalks; they then approved the re‑subdivision with 13 conditions, replacing condition seven with the fee‑in‑lieu of open space payment.
The approval is conditioned on meeting the items in the staff memo and the payment of the prescribed fees prior to final mylar recording and any building permits.
