Kelley holds second reading of nuisance-abatement ordinance; council records 4–1 vote

The Kelley City Council held the second reading of Ordinance #182, the city’s Nuisance Abatement Procedure, on Nov. 12 and reviewed revised language intended to clarify what constitutes nuisance conditions.

During the reading the council amended the ordinance language to remove certain verbiage and replace it with text that defines "accumulation of junk" to include material such as scrap lumber, inoperable or unlicensed vehicles, unused equipment, unsightly furniture and other items that are "unreasonably offensive or tend to adversely impact the economic fair market value of other properties in the immediate vicinity." The ordinance also specifies "failure to maintain structures" with examples including broken or rotted siding, defective or missing shingles, and uncompleted additions that render a premise "unsightly and offensive to the senses."

Ben Adams moved and Kelly Netcott seconded to hold the second reading with the revised verbiage. On the roll call vote Adams, Netcott, Tim Salasek and Jackie Sapp voted aye; Brendan Burtnett voted nay. The minutes record the roll call as Ayes — Adams, Netcott, Salasek, Sapp; Nays — Burtnett.

The minutes do not record further public comment on the ordinance at this meeting. The council may schedule subsequent readings or a final adoption vote in a future meeting consistent with the city's ordinance-adoption process.
