The Paynesville City Council adopted a local policy to implement the state's ESS (sick and safe) law by keeping ESS as a separate accrual bank rather than folding it into PTO.
Staff explained two options: leave ESS within PTO (which would make PTO fully equivalent to ESS and limit managerial flexibility) or create a separate ESS bank in which employees accrue one hour of ESS for every 30 hours worked up to 48 hours annually, with carryover allowed to a maximum of 80 hours. Policies & Procedures and the city's labor attorney recommended the second option. Council discussed front-loading, payout risk, how ESS use interacts with liquor store and public safety staffing, and carryover. Members determined that the separate-accrual approach (option two) best balances statutory compliance with operational needs.
A motion by soy to adopt option two carried on an oral vote with no opposition recorded. Staff noted ESS will not be front-loaded and there will be no payout of ESS on separation; the city will permit carryover up to the statutory cap.
