Bernalillo council approves 300-foot waiver to allow Brew Fest alcohol service near churches

The Town of Bernalillo on Aug. 8 approved a local waiver of the 300-foot rule under Section 60-6B-10 of the Liquor Control Act to allow temporary service of beer, wine and spirits for the Mountain West Brew Fest at Loretto Community Park on Aug. 27.
Community Development staff described the waiver request as allowing temporary alcohol service within 300 feet of Our Lady of Sorrows Church, First Assembly of God Church, Potters House Church and PB & J Therapeutic Preschool. The staff presentation listed participating breweries and wineries, and the council voted unanimously (4–0) to authorize the waiver and to authorize Mayor Torres to sign any Celebration Permit applications received before the state deadline.
The motion’s approval directs staff to submit applications to the State of New Mexico Alcohol and Gaming Division and to follow the limits described in state law for temporary licenses; no council member raised an objection during the vote. The waiver is effective for the event date listed in the request and does not change permanent licensing near the sites named in the staff report.
Representatives of the event and staff should follow the state’s permitting process and any conditions attached to the local waiver. The council did not discuss specific mitigation measures such as extra security or ingress/egress plans during the public portion of the item.
